Since October 26, 2015, Citizenship and Immigration Canada (CIC) has introduced a new electronic system, the Employer Portal.
Employers must now submit offers of employment in Labour Market Impact Assessment (LMIA) -exempt situations directly to CIC using this system. The previous form, IMM 5802 – offer of employment to a foreign national exempt from the Labour Market Impact Assessment – will no longer be accepted from November 21, 2015.
If an employer has already provided a completed form to a foreign worker, the worker should submit a work permit application prior to November 21, 2015. If the foreign worker does not submit its application before this date, the employer must resubmit the offer of employment using the Employer Portal.
This Portal is designed for employers participating in the International Mobility Program (IMP) and allows employers to submit offers of employment for each LMIA-exempt foreign national they hire. Employers should make sure they do not need an LMIA before they submit an offer of employment. CIC requires the use of an electronic credential to access the Employer Portal. This electronic credential can be a GCKey or a Sign-In Partner (SecureKey Concierge).
The Employer Portal is part of changes introduced by CIC on February 21, 2015.
