This Privacy Policy (the “Policy”) governs how we, MONTRÉAL INTERNATIONAL (“MTL INTL” or “We”) may collect, use, disclose and retain your personal information in connection with your use of our websites and our platforms, which include, on the date of the Policy review,

as well as social media (Facebook, LinkedIn, Twitter, Instagram, YouTube account or page, TikTok) of MTL INTL, which include, on the date of the Policy review, the pages or accounts of Montréal International, Je choisis Montréal and Talent Montréal (collectively, the “social networks”) (the websites and social networks hereinafter collectively, the “Platforms”).

We are committed to respecting your privacy and protecting your personal information. We are committed to protecting your personal information and using it only for the purposes for which it was collected. The purpose of this Policy is to inform you about our privacy practices with respect to personal information collected through our platforms.

1. SCOPE AND APPLICATION

The term “Personal Information” refers to any information that, taken alone or in combination with others, can identify an individual.

The Policy extends to all personal information that may be collected by MTL INTL when you use one or more of our websites.

This Policy is an integral part of the Terms and Conditions of Use of each platform, when available, which govern your use of the platforms.

2. INFORMATION YOU PROVIDE US

We may collect certain information that you voluntarily provide when you use certain features of the platforms, such as when you register for one of our newsletters. Some of our platforms also offer you the possibility to create an account in order to apply for a job. We may also collect certain information when you communicate with us by e-mail, private messaging on our social media networks or otherwise, for example, to obtain information or to report a problem with the platforms. This personal information we collect may include your first name, last name, postal address, telephone number, e-mail address, job title and the name of the organization for which you work, professional contact information, your message sent to MTL INTL via one of our contact forms. In the event that you choose to use these features, such as to create an account on the platforms, we may also collect information associated with your social media account(s), such as your username, profile picture, description contained in your profile/account and e-mail address associated with your profile/account. In the event that you create an account on our platforms, you may be asked to create your username and password. It is your responsibility to establish and maintain your information up-to-date and to ensure the confidentiality and security of your account, if any, including keeping your password secret.

You must keep in mind that any information and content that you voluntarily provide through the public features of the platforms, when applicable, or that is otherwise visible to other users of the platforms may be collected or used by anyone. This may include, but is not limited to, your identifying information and any content submitted, including any message, publication, testimonial, photo or video. We disclaim any responsibility to this effect and make no warranty as to the protection of this information provided.

MTL INTL may also collect your name and e-mail address when you have consented to it in order to communicate with you by e-mail, within the limits permitted by applicable laws. More specifically, but without limitation, MTL INTL may send you commercial e-mails if (i) you have expressly consented to it; (ii) you are one of its customers or partners; or (iii) you are working in an industry related to MTL INTL’s activities and you have expressed your interest to us through the delivery of your business card or by telephone to one of our employees or representatives; or (iv) that you have published, or permitted to be published, your e-mail address in a prominent place, online or on a list maintained by a third party.

By using the Pair Connex Platform, you understand that the features offered by registering for an account include the ability to share your personal information with other participants in order to facilitate exchanges, as well as the possibility of receiving notifications by text message (SMS).

By participating in a Je Choisis Montréal initiative, you consent to MTL INTL obtaining information about you from participating employers as part of MTL INTL’s accountability to its funders.

3. ELECTRONIC INFORMATION

When you visit the platforms, we may use performance tools provided by third parties, such as Google Analytics and LinkedIn Ads, to collect information that is not of a personal nature, such as the Internet browser and type of operating system you are using, the country from which you access our platforms and the domain name from which you were directed to one of our platforms (collectively, ”Electronic Information”). Google Analytics uses cookies to collect statistical data in aggregate form to analyze how visitors use a website. These cookies are used to store non-personally identifiable information. If you do not wish to provide information to Google Analytics, you may choose to disable the use of your data by using the Google Analytics Opt-out Browser Add-on available at https://tools.google.com/dlpage/gaoptout. In addition, when you visit one of our platforms, we may introduce a data file on your computer, tablet or mobile device (collectively, “Device”), such as a cookie, a pixel tag (very small graphic element) or similar file. These files allow us to keep certain information about your use of the platforms, including the date of your most recent visit, the pages viewed and the files downloaded. They allow us to adapt our platforms to better meet the interests and preferences of our users. These files may also be used by MTL INTL or its partners for targeted marketing purposes to present you with content or ads that we believe may be of interest to you based on your browsing behaviour on the platforms. As such, MTL INTL uses cookies provided by third-party platforms, including, without limitation, LinkedIn, Facebook and Google Marketing Platform, to provide you with ads and content that may be of interest to you. You have the option to disable these cookies in the future if you wish by managing your preferences via the features available for this purpose on the websites. The use and management of these cookies are also subject to the policies and conditions of the third party involved.

Some of our partners, such as third parties whose ads we serve on one of our platforms, may also place cookies, pixel tags or other files on your device to measure the effectiveness of their partnerships or advertising messages and collect anonymous data about how users use our platforms. None of the data collected by these third parties allows to identify you personally. In addition, our e-mail service providers may also place files such as cookies and pixels in your device via e-mails sent on our behalf that you receive, including for the purpose of analyzing the performance of e-mail campaigns and improving its services. The collection, use and management of the information thus collected are then subject to the terms and conditions of the concerned supplier. If you do not agree to these Terms and Conditions, please do not subscribe to our newsletter, or unsubscribe, if applicable. At any time, you may refuse or disable cookies or pixels if your browser allows it. To do this, consult your browser’s configuration options. However, in such a case, you may have difficulty navigating on our platforms or using all or part of their features. Most Internet browsers allow you to delete cookies from your device’s hard drive, block them or receive a warning before downloading them. Please refer to your browser instructions to learn more about these functions.

4. WHY WE COLLECT INFORMATION

The above information is collected and used as described above, and in particular for the following purposes:

  • in order to offer you MTL INTL’s products and services;
  • to communicate with you in connection with the provision of our products and services that you have requested or registered for through our platforms or otherwise;
  • to administer our contests and promotions, within the limits permitted by applicable laws;
  • in order to address the problems reported to us;
  • to evaluate, including through surveys, and improve the content of our platforms and services to make them more relevant or of interest to users and to help us develop other products and services of interest to the public;
  • in order to meet our obligations towards our contractors and suppliers;
  • to send you information, offers and other communications by e-mail, within the limits permitted by applicable laws;
  • to provide you with advertising content, including retargeting, to evaluate the effectiveness of our partnerships and advertising messages on our platforms and to improve their content so that it is more relevant or of interest to the public.

We only use personal information for the purposes for which it was collected.

5. HOW YOUR INFORMATION CAN BE SHARED

We never disclose your personal information to anyone outside MTL INTL, except as indicated below:

  • Service Providers

We may disclose personal information to our suppliers whose services have been retained to perform certain functions on our behalf (e.g., data processing and management, payment processing, e-mailing, database maintenance).

In this case, we take the necessary measures to ensure that these third parties have access only to information that is necessary to carry out their responsibilities, that they process your information only for the purposes we have identified and that they have in place privacy safeguards that comply with applicable laws and meet the same conditions and level of protection as set out in this Policy;

Theses Services Providers are :

  • Sale, merger or change of control

We may disclose personal information to any entity in the event of a merger or change of control of MTL INTL, in whole or in part, only if the parties have signed an agreement stating that the collection, use and disclosure of the information is limited to the purposes of the commercial transaction; and

  • Other legitimate reasons

We may disclose personal information to any public authority if required by law, or to defend our rights, or otherwise in accordance with the law. If MTL INTL must disclose information or provide a copy of the information to a government agency pursuant to a law or court order, MTL INTL will attempt to notify you in advance to the extent permitted by law. In such circumstances, we will only disclose as much personal information as is reasonably necessary to fulfill the purposes.

With your consent In addition to the above purposes, we may, with your implied or express consent, communicate or disclose your personal information with persons or entities outside MTL INTL. For example, when you create a profile on the Study Connect platform, you explicitly consent to certain information being shared with the Ministère de l’Immigration, Francisation et Intégration du Québec (MIFI), for reporting and statistical purposes. In addition, when you create a profile on the Talent Montréal as part of your participation in Québec-Mexico Day 2024, you consent that Montréal International may share some of your personal information with its local employment partner, Servicio Nacional de Empleo (SNE), for reporting purposes. This disclosure will be made only once in the 12 months following the submission of your application, and will be accessible only to authorized staff in the course of their duties.

6. HYPERLINKS AND THIRD PARTIES

Platforms may contain sharing or publishing options or links to third-party websites or social networks. By using or activating these links or features, you leave our platforms and your browsing becomes subject to the terms and conditions of use and privacy policy of these third parties. We have no control over these third-party platforms and the fact that these platforms are listed on our own does not engage our responsibility.

7. SECURITY AND CONSERVATION

All your information that we collect through the websites is stored on servers with high security guarantees located in Canada or, in the case of information collected related to your interaction with our newsletters, in the United States. MTL INTL uses technical and organizational measures to protect your personal information against loss or theft and unauthorized access and disclosure, both within and outside our organization.

Personal information obtained through the collection of files placed on websites by third party platforms is retained in accordance with the policies of those third parties. In other situations, MTL INTL retains personal information for a reasonable period of time either to fulfill the purposes for which it was collected or in accordance with the provisions of the law. For example, if you have registered for our newsletters, your name and e-mail address will be kept for as long as you remain registered and to the extent necessary, in the event that you subsequently choose to unsubscribe. Once the purposes have been accomplished and the personal information is no longer required, we ensure that it is anonymized  in order that no individual is identifiable, or we destroy it in a safe way.

As regards the www.talentmontreal.com site, MTL INTL sends a notification for deletion after eleven (11) months of account inactivity. If there is no objection, MTL INTL will proceed to anonymize the data after twelve (12) months.

8. YOUR RIGHTS

You have the right to know the purpose of MTL INTL’s collection and processing of your personal information, as well as the right to access, update or correct your personal information. You may at any time withdraw your consent to MTL INTL’s use and retention of your personal information, request the deletion of your personal information or object to the processing of your personal information by MTL INTL. In such a case, however, you may no longer be able to access all or part of our platforms and/or some of their features. You also have the right to the portability of your personal information.

9. APPLICABLE LAW AND JURISDICTION

This Policy is governed by the laws of the Province of Quebec and the federal laws applicable therein. Any dispute, recourse or claim arising out of or in connection with the use of the site must be resolved by negotiations in good faith between the parties. If such negotiations prove insufficient, such dispute, recourse or claim shall be submitted to the exclusive jurisdiction of the competent courts in the judicial district of Montreal, province of Quebec, Canada.
